As a photo licensing agency, our role is to license images to publishers who then determine how to use those photos. When we authorized, through our French agent the use of Michael Yon’s photo to Hachette Filipacchi Media for their French Choc magazine, and then later for Hachette Filipacchi’s Shock magazine in North America, we had no further control of how that image would be used, nor did we know at that time that the photo had been taken by Michael Yon. The image had not been supplied to us by Michael Yon, and we have never had communications or any business relationship with Michael Yon. After the use in Shock Magazine when we learned that we had no right to license that image, we removed the image and worked in good faith with Michael Yon to resolve the issue. We appreciate that Michael Yon settled the matter with us in a professional manner. We respect our service members, veterans and their friends and family and the sacrifices they make.
